Get Help from Our Abilene Workplace Injury Lawyers
Our Abilene workplace injury lawyers can handle cases involving defective products
Our workplace injury lawyers usually encounter two varieties of worker injury: Immediate (acute) injuries, and latent injuries. Acute injuries often include chemical burns or toxic poisoning from skin exposure or breathing vapor. Latent injuries include diseases to vital organs and cancer.
Latent workplace injury cases can be difficult to prove because a great deal of time may pass before a diagnosis is possible. For cases that involve asbestos and mesothelioma, you need help from a qualified Abilene workplace injury lawyer who has experience with these sensitive cases.
If you believe that you’re injury or illness was caused by a toxic substance, talk to an attorney and get the facts. Mesothelioma cases have an extensive history in court, and may be easier to prove than cases involving less-known substances. The goal of our Abilene workplace injury attorneys is to make sure your legal rights are protected every step of the way.
What if your employer’s conduct or negligence led to your injury?
In Texas, you can bring a civil action against an employer that intentionally causes you injury. These actions often seek damages that go beyond what is covered by worker’s compensation insurance. This means that if your employer physically assaults you in any way, you can sue them for their actions.
It also means that if they act in some grossly negligent way that causes you injury, you can also pursue civil litigation in the form of a workplace injury lawsuit. If your employer forced you to work under conditions that were non-compliant with government regulations, and it resulted in your injury, this is likely the kind of action your workplace injury lawyer would pursue.
I was injured, but my employer didn’t carry worker’s compensation insurance. Now what?
If you’re injured on the job and your employer is uninsured, you can pursue a lawsuit for compensation. You may also want to consider this action if the money required for full compensation is more than the payout from our worker’s compensation claim.
More examples of workplace injury liability
Employers routinely fail to provide workers with minimal safety measures. Often, complacency is the culprit. An employer may go years without a workplace injury, causing them to relax the safety standards they once followed to the letter. At other times, money problems may motivate an employer to cut safety standards, or hire personnel who lack the qualifications to do their job. In every one of these situations, the person who suffers is the innocent worker just trying to do their job.
Wrongful death in the workplace
In the most tragic cases of workplace injury, employees suffer death as a result of their injuries or exposure to toxic substances like asbestos. If someone you love lost their life due to a workplace injury or toxic exposure, contact our legal team to discuss whether you can file a wrongful death claim.
Money may seem trivial when compared to the significance of your loss, but financial considerations must be made to protect your future and that of your family. This is especially true if the deceased was the home’s primary wage-earner. Persons who can file a wrongful death claim include the deceased’s parents, children, and spouse.
